“Cooling-off” does not apply to mail order sales.

We are often asked by people who have purchased a product from a mail order company but want to return it if a “cooling-off” period applies.

「通信販売で商品を購入したが、返品したい。クーリング・オフはできるか?」という相談がよくあります。

“Cooling-off” is a system to protect consumers who have signed a contract without thinking due to surprise solicitation such as door-to-door or telemarketing sales. Under this system, the consumer can unilaterally and unconditionally cancel the contract within a certain period of time.

クーリング・オフは、訪問販売や電話勧誘販売のように不意打ち的な勧誘で、思いがけず契約してしまった消費者を保護するための制度です。一定期間内であれば、消費者側からの一方的かつ無条件の契約解除ができます。

However, in the case of mail order sales, consumers who have seen an advertisement have time for careful consideration before making a purchase. For this reason, the cooling-off system does not apply to mail order sales because there is no element of surprise solicitation. When making mail order purchases, be sure to carefully check information such as the “return policy” and “conditions for return or exchange” in advance, and place your order only after you are satisfied with the terms and conditions.

ところが通信販売は、広告を見た消費者が、よく考えて購入することができます。このため不意打ち的な勧誘の要素は無いと判断されており、クーリング・オフ制度の対象外となっています。通信販売を利用する際は、必ず事前に「返品の可否」や「返品・交換の条件」をよく確認し、納得した上で注文するようにしましょう。
